 PART I Preliminary
  
  hort title
  Ordinance may be cited as the Merchant Shipping 
(Liability and
  ensation for Oil Pollution) Ordinance.
  nterpretation
  In this Ordinance, unless the context otherwise requires--
  t" includes expenses;
  ntry" includes any territory;
  rt" means the High Court or a judge thereof;

  lution damage" means damage caused outside a ship carrying 
oil by
  amination resulting from the discharge or escape of oil from the
ship,
  ever the discharge or escape may occur, and includes the 
cost of
  entive measures and damage caused by preventive measures;
  ventive measures" means any reasonable measures taken by any 
person
  r a discharge or escape of oil from a ship to prevent or 
reduce
  ution damage;
  p" means any sea-going vessel or seaborne craft of 
any  type
  soever, carrying oil in bulk as cargo;
  cial drawing rights" means units of account used by the 
International
  tary Fund and known as special drawing rights;
  minal installation" means any site for the storage of oil in

  h is capable of receiving oil from waterborne 
transportation,
  uding any facility situated offshore and linked to any such site.
  For the purposes of this Ordinance, where more than one 
discharge or
  pe results from the same occurrence or from a series of 
occurrences
  ng the same origin, they shall be treated as one; but any 
measures
  n after the first of them shall be deemed to have been taken after
the
  harge or escape.
  References in this Ordinance to the area of any country include 
the
  itorial sea of that country.

  alculation of tonnage
  the purposes of this Ordinance, the tonnage of a ship 
shall be
  rtained as follows--
  where the register tonnage of the ship has been or can be 
ascertained
  ccordance with the Merchant Shipping (Tonnage) Regulations 
(App. I,
  , the ship's tonnage shall be the register tonnage of the ship 
as so
  rtained but without making any deduction required by those
regulations
  ny tonnage allowance for propelling machinery space;
  where the ship is of a class or description with respect to which 
no
  ision is for the time being made by the Merchant Shipping 
(Tonnage)
  lations, the tonnage of the ship shall be taken to be 40% 
of the
  ht (expressed in tons of 2 240 lbs) of oil which the ship is 
capable
  arrying;
  where the tonnage of the ship can not be ascertained in 
accordance
  either paragraph (a) or (b), the Director shall, if so directed 
by
  court in any proceedings, certify what, on the evidence 
specified in
  direction, would in his opinion be the tonnage of the 
ship as
  rtained in accordance with paragraph (a) or (b), as the case may 
be,
  he ship could be duly measured for the purpose; and the tonnage
stated
  is certificate shall be taken to be the tonnage of the ship.
 PART II LIABILITY FOR OIL POLLUTION AND COMPULSORY INSURANCE
  
  nterpretation of Part II
  In this Part--
  bility Convention country" means a country in respect of 
which the
  ility Convention is in force; and
  bility Convention State" means a State which is a party 
to the
  ility Convention.
  In relation to any pollution damage resulting from the 
discharge or
  pe of any oil carried in a ship references in this Part to the 
owner
  he ship are references to the owner at the time of the 
occurrence
  lting in the discharge or escape or, if there is more than one 
such
  rrence, at the time of the first of such occurrences.
  References in this Part to the Merchant Shipping Act 1979 (1979
c. 39
  .) are references to that Act as it applies in Hong Kong.
  
  iability for oil pollution
  Where, as a result of any occurrence taking place while a 
ship is
  ying a cargo of persistent oil in bulk, any persistent oil carried 
by
  ship (whether as part of the cargo or otherwise) is 
discharged or
  pes from the ship, the owner of the ship shall be liable, except 
as
  rwise provided by this Ordinance, for any pollution damage 
caused in
  Kong.
  Where--
  a liability arises under subsection (1); and
  the discharge or escape by reason of which the liability arose 
also
  lts in pollution damage in the area of a Liability Convention 
country
  r than Hong Kong, the owner of the ship concerned shall also be
liable
  r subsection (1) for that damage as if the damage had occurred
in Hong
  .
  Where persistent oil is discharged or escapes from 2 or more 
ships
  -
  a liability is incurred under this section by the owner of 
each of
  ; but
  the pollution damage for which each of the owners would, apart 
from
  subsection, be liable cannot reasonably be separated from that 
for
  h the other or others would be liable,
  of the owners shall be liable, jointly with the other or others, 
for
  whole of that damage for which the owners together would be 
liable
  r this section.
  Section 21 of the Law Amendment and Reform (Consolidation)
Ordinance
  . 23) shall apply in relation to any pollution damage for 
which a
  on is liable under this section, but which is not due to his fault,
as

  resulted from an act of war, hostilities, civil war, 
insurrection or
  xceptional, inevitable and irresistible natural phenomenon; or
  was due wholly to anything done or left undone by another person, 
not
  g a servant or agent of the owner, with intent to do damage; or
  was due wholly to the negligence or wrongful act of a 
government or
  r authority in exercising its function of maintaining lights or 
other
  gational aids for the maintenance of which it was responsible.

  imitation of liability under section 6
  e the owner of a ship incurs a liability under section 6 by reason 
of
  scharge or escape which occurred without his actual fault or 
privity,
  ay limit that liability in accordance with this Ordinance, and 
if he
  so his liability (that is to say, the aggregate of his 
liabilities
  r section 6 resulting from the discharge or escape) shall not
exceed--
  133 special drawing rights for each ton of the ship's tonnage;
or
  14,000,000 special drawing rights, whichever amount is the less.
  
  Limitation actions
  Where the owner of a ship has or is alleged to have 
incurred a
  ility under section 6 he may apply to the court in accordance 
with
  s of court for the limitation of that liability to 
an amount
  rmined in accordance with section 9.
  If on such an application the court finds that the 
applicant has
  rred such a liability and is entitled to limit it, the court 
shall
  rmine the limit of the liability and direct payment into court
of the
  nt of that limit, and shall then
  determine the amounts that would, apart from the limit, be 
due in
  ect of the liability to the several persons making claims 
in the
  eedings under this section; and
  direct the distribution of the amount paid into court (or, as the
case
  be, so much of it as does not exceed the liability) among 
those
  ons in proportion to their claims subject to the following 
provisions
  his section.
  A payment into court of the amount of a limit determined under 
this
  ion shall be made in Hong Kong dollars and--
  for the purposes of converting such an amount from special 
drawing
  ts into Hong Kong dollars the Monetary Authority may certify, in 
Hong
  dollars, the respective amounts which are to be taken as 
equivalent
  a particular day to the sums expressed in special drawing 
rights in
  ion 9;
  a certificate signed by or on behalf of the Monetary Authority 
under
  graph (a) shall be conclusive evidence of the matters 
contained
  ein and shall in legal proceedings under this Ordinance to 
which it
  tes be admissible on its production and without further proof.

  No claim shall be made in proceedings under this section except
within
  time as the court may direct or such further time as the court 
may
  w.
  Where any sum has been paid in or towards satisfaction of any claim
in
  ect of the pollution damage to which the liability referred 
to in
  ection (1) extends--
  by the owner or the person referred to in section 17 as "the
insurer";
  
  by a person who has or is alleged to have incurred a 
liability,
  rwise than under section 6, for that damage and who is 
entitled to
  t his liability in connection with the ship by virtue of the 
Merchant
  ping Act 1979 (1979 c. 39 U. K.), the person who paid the sum 
shall,
  he extent of that sum, be in the same position with respect to 
any
  ribution made in proceedings under this section as the person to 
whom
  as paid would, apart from this subsection, have been, 
and the
  ribution shall be made accordingly.
  Where the owner who incurred the liability referred to in
subsection
  has voluntarily made any reasonable sacrifice or taken 
any other
  onable measures to prevent or reduce pollution damage to 
which the
  ility extends or might have extended he shall be in the same 
position
  respect to any distribution made in proceedings under this
section as
  e had established a claim in respect of the liability for an 
amount
  l to the cost of the sacrifice or other measures, and the
distribution
  l be made accordingly.
  The court may, if it thinks fit, postpone the distribution of 
such
  of the amount to be distributed as it deems appropriate having
regard
  ny claims that may later be established before a court outside 
Hong
  .
  
  Restriction on enforcement of claims after establishment of
limitation
  
  e the court has found that a person who has incurred a liability
under
  ion 6 is entitled to limit that liability to any amount and 
he has
  into court a sum not less than that amount--
  the court shall order the release of any ship or other 
property
  sted in connection with a claim in respect of that liability or 
any
  rity given to prevent or obtain release from such an arrest; and
  no judgment or decree for any such claim shall be enforced, except 
so
  as it is for costs,
  sum paid into court, or such part thereof as corresponds to the
claim,
  be actually available to the claimant or would have been available
to
  if the proper steps in the proceedings under section 10 
had been
  n.
  Concurrent liabilities of owners and others
  e, as a result of any discharge or escape of persistent oil 
from a
  , he owner of the ship incurs a liability under section 6 and 
any
  r person incurs a liability, otherwise than under that section, 
for
  such pollution damage as is mentioned in subsection (1) 
of that
  ion, then, if--
  the owner has been found, in proceedings under section 10, 
to be
  tled to limit his liability to any amount and has paid into 
court a
  not less than that amount; and
  the other person is entitled to limit his liability in connection
with
  ship by virtue of the Merchant Shipping Act 1979 (1979 c. 39 U. 
K.),
  roceedings shall be taken against the other person in respect of 
his
  ility, and if any such proceedings were commenced before the 
owner
  the sum into court, no further steps shall be taken 
in the
  eedings except in relation to costs.
  Establishment of limitation fund outside Hong Kong
  e the events resulting in the liability of any person under
section 6
  result in a corresponding liability under the law of a 
Liability
  ention country other than Hong Kong, sections 11 and 12 shall
apply as
  he references to sections 6 and 10 included references 
to the
  esponding provisions of that law and the references to sums paid 
into
  t included references to any sums secured under those 
provisions in
  ect of the liability.
  Extinguishment of claims under Part II
  ction to enforce a claim in respect of a liability incurred 
under
  ion 6 shall be brought in any court in Hong Kong unless the action 
is
  enced not later than 3 years after the claim arose and not later 
than
  ars after the occurrence or, if there is more than 
one such
  rrence, the first of such occurrences resulting in the 
discharge or
  pe by reason of which the liability was incurred.
  
  Compulsory insurance against liability for oil pollution
  Subject to section 19, subsection (2) applies to any ship carrying 
in
  a cargo of more than 2,000 tons of persistent oil as 
defined in
  lations made under this section.
  A ship to which this subsection applies shall not enter or leave--
  the waters of Hong Kong; or
  if the ship is a Hong Kong ship, a port in any other country 
or a
  inal installation in the territorial sea of any other country, 
unless
  e is in force a certificate complying with subsection 
(4) and
  ifying that there is in force in respect of the ship a 
contract of
  rance or other security satisfying the requirements of Article

     《江苏省云台山风景名胜区管理条例》已由江苏省第十届人民代表大会常务委员会第二十八次会议于2007年1月16日通过,现予公布,自2007年3月1日起施行。

 第一章 总  则

  第一条 为了加强云台山风景名胜区管理,有效保护和合理利用风景名胜资源,根据国务院《风景名胜区条例》和有关法律、行政法规,结合云台山风景名胜区实际,制定本条例。

  第二条 本条例适用于云台山风景名胜区(以下简称风景区)的规划、保护、建设、利用和管理等活动。

  第三条 风景区的范围以国务院批准的《云台山风景名胜区总体规划》(以下简称风景区总体规划)确定的范围为准。

  风景区分为一级保护区、二级保护区和三级保护区。保护区的具体界线由连云港市人民政府(以下简称市人民政府)根据风景区总体规划划定并公布。

  第四条 风景区管理坚持科学规划、统一管理、严格保护、永续利用的原则。

  第五条 省人民政府建设行政主管部门(以下简称省建设部门)负责风景区的监督管理工作。

  市人民政府设立的风景区管理机构(以下简称管理机构),依据有关法律、法规和本条例的规定,负责风景区的保护、利用和统一管理工作。

  景区所在地区人民政府和市规划、建设、国土资源、环境保护、公安、交通、旅游、工商、文物、宗教、林业、海洋与渔业等部门按照各自职责,共同做好风景区的保护与管理工作。

  第六条 连云港市人民代表大会常务委员会应当加强对风景名胜区管理的法律、法规以及风景区规划贯彻执行情况的监督。

  第七条 管理机构应当加强风景名胜区管理法律、法规的宣传,增强公众自觉保护风景名胜资源的意识。

  任何单位和个人都有保护风景名胜资源的权利和义务,有权检举和制止破坏风景名胜资源的行为。

  对在风景区保护和管理工作中作出重要贡献的单位和个人,由市人民政府或者管理机构给予表彰和奖励。

  第二章 规  划

  第八条 风景区规划是风景区保护、建设、利用和管理的依据。

  风景区规划分为风景区总体规划和详细规划。

  第九条 风景区总体规划的修编,按照国务院《风景名胜区条例》的规定执行。

  省建设部门会同市人民政府,根据风景区总体规划、省海洋功能区划和连云港市城市总体规划,组织编制风景区详细规划,并依法报经批准。

  风景区详细规划应当根据景区保护的不同要求编制,确定基础设施、旅游设施、文化设施等建设项目的选址、布局与规模,并明确建设用地范围和规划设计条件。

  第十条 市人民政府应当组织管理机构和有关部门,根据风景区总体规划、详细规划,制定风景区内旅游发展、环境保护、基础设施建设和人口控制等实施计划。

  第十一条 风景区规划一经批准,任何单位和个人不得擅自改变。确需对风景区总体规划中的风景区范围、性质、保护目标、生态资源保护措施、重大建设项目布局、开发利用强度以及风景区的功能结构、空间布局、游客容量进行修改,或者对风景区详细规划进行修改的,应当依法报经原审批机关批准。

  第三章 保  护

  第十二条 管理机构应当会同有关部门对风景区内的纪念性建筑、文物古迹、历史遗址、园林等人文景观和古树名木、野生动植物、地形地貌、山体岩石、泉湖水体等自然景观进行调查和登记,按照风景区规划的要求和分类保护的原则,建立健全资源保护的各项管理制度。

  对海清寺塔、藤花落史前城址、玉女峰、郁林观石刻、延福观、大桅尖、孔望山摩崖造像、马耳峰、将军崖岩画等重要景点和重点文物保护单位,应当根据其特点制定相应的保护措施,实行严格保护。

  第十三条 风景区的建设活动,应当符合风景区总体规划和详细规划。

  一级保护区内禁止建设与原景物景象景点等景观风景无关的工程设施。

  二级保护区、三级保护区的核心景区内,禁止建设宾馆、招待所、培训中心、疗养院以及与风景名胜资源保护无关的其他建筑物。

  第十四条 风景区一级保护区、二级保护区内,不得新建、扩建工业企业;三级保护区内,不得新建、扩建污染环境、妨碍景观的工业企业。

  市人民政府应当制定计划,逐步将风景区内已有的污染环境、妨碍景观的工业企业迁出景区。

  第十五条 风景区内的重点保护海域,包括前三岛周围四海里内海珍品自然保护区域,海滨浴场以及浅海水产养殖区等,不得设置排污口和建设破坏景观的海岸工程。在海滨景观带的海域内控制海水养殖规模。

  海滨一级保护区内,禁止填海毁坏沙滩,保持苏马湾、大沙湾和连岛北部的完整性。

  第十六条 风景区内禁止下列行为:

  (一)开山、采石、开矿、开荒、修坟立碑等破坏景观、植被和地形地貌的活动;

  (二)在文物、景物或者设施上涂写、刻划;

  (三)盗伐、攀折、刻划林木;

  (四)捕杀野生动物;

  (五)焚烧树叶、荒草、垃圾;

  (六)在禁火区内吸烟、动用明火;

  (七)乱扔垃圾;

  (八)损毁公用设施;

  (九)修建储存爆炸性、易燃性、放射性、毒害性、腐蚀性物品的设施;

  (十)法律、法规禁止的其他行为。

  第十七条 管理机构和有关部门应当制定风景区内水体保护的具体措施,落实保护责任,明确保护要求,防治水体污染。

  禁止向风景区内的水体排放污水、倾倒垃圾和其他废弃物。

  第十八条 风景区内的林木,应当进行抚育管理,不得砍伐;确需进行更新、抚育性采伐的,应当依法报经林业主管部门批准。

  管理机构和有关部门应当做好植树绿化和防治病虫害工作,保护林木植被和物种生长条件。

  在风景区内采集物种、标本、野生药材和其他林副产品,应当经管理机构同意,在限定的数量和指定的范围内进行。

  第十九条 对景观、植被资源破坏严重的地区,当地人民政府应当采取封山育林等措施,逐步恢复景观和植被。

  第四章 建  设

  第二十条 风景区的建设应当按照规划进行,根据财力和物力,合理利用风景名胜资源。

  市人民政府及其有关部门应当加强风景区内道路、通信、供水、排水、供电、供气等基础设施建设,改善交通、服务设施和游览条件。

  第二十一条 在风景区内从事本条例禁止范围以外的建设活动,应当经管理机构审核后,依照有关法律、法规的规定办理审批手续。

  第二十二条 风景区内经批准新建、改建、扩建的建筑物、构筑物和其他设施,不得超出批准的规划用地范围,其布局、高度、体量、造型、色调等应当符合批准文件的要求,并与周围景观和环境相协调。

  第二十三条 建设项目在施工过程中,应当采取有效措施,保护周围景物、林木、植被、水体和地貌,不得造成污染和损坏。建设项目竣工后,建设单位应当及时清理场地,进行绿化,恢复周围环境原貌。

  第五章 管  理

  第二十四条 市人民政府应当采取限制迁入和居民搬迁等措施,严格控制并逐步减少风景区内的常住人口和暂住人口数量。

  第二十五条 设在风景区的所有单位,进入、居住在风景区的个人,应当服从管理机构的统一管理,自觉遵守风景区的有关规定,保护风景名胜资源,爱护公共设施,维护环境卫生和公共秩序。

  第二十六条 风景区内的交通、商业等服务项目,应当由管理机构依照有关法律、法规和风景区规划,通过招标等公平竞争的方式确定经营者。

  管理机构应当与经营者签订合同,依法确定各自的权利义务。经营者应当按照合同约定的地点和营业范围从事经营活动。

  经营者应当缴纳风景名胜资源有偿使用费。风景名胜资源有偿使用费依法实行收支两条线管理,专项用于风景区的保护和管理以及风景区内财产的所有权人、使用权人损失的补偿。

  第二十七条 管理机构应当采取措施,限制机动车辆进入核心景区。确需进入的,应当服从统一管理,按照指定的路线、地点行驶和停放。

  第二十八条 管理机构应当加强对风景区规划实施情况的动态监督管理,及时发现和制止各种破坏景观和生态环境的行为。

  第二十九条 管理机构和有关部门应当对风景区内的公用设施进行定期检查和维护,在风景区的险要部位设置必要的安全设施和警示牌,制定应急预案,做好风景区的安全防范和管理工作。

  第三十条 管理机构和有关部门应当制定防火、避雷、防震等专项措施,健全防火组织,完善防火设施,加强对风景区内文物古迹、古树名木的保护。

  第三十一条 管理机构应当妥善处理污水、垃圾,加强监督检查,维护景区容貌,改善环境卫生。对沟谷、洞穴、水体等不易清扫的地方,应当定期清理。

  第三十二条 管理机构应当建立健全档案制度,对风景区的历史沿革、发展变化、资源状况、范围界限、生态环境、各项设施、开发建设、旅游接待、经营状况等方面进行调查统计,形成完整资料,妥善保存。

  第六章 法律责任

  第三十三条 违反本条例规定,有下列行为之一的,由管理机构责令改正,造成经济损失的,责令赔偿损失,可以并处罚款:

  (一)修坟立碑的,责令限期迁出,恢复地形原貌,处以一千元以上五千元以下罚款;

  (二)擅自在核心景区从事商业经营活动的,处以二十元以上二百元以下罚款;

  (三)在禁火区内吸烟的,处以二十元以上一百元以下罚款,焚烧树叶、荒草、垃圾或者在禁火区内动用明火的,处以五十元以上五百元以下罚款;造成后果的,处以一千元以上五千元以下罚款,构成犯罪的,依法追究刑事责任。

  对在风景区内违法从事建设活动等违反本条例规定的其他行为,由管理机构或者有关部门依照国务院《风景名胜区条例》等相关法律、法规进行处罚。

  第三十四条 管理机构和有关部门工作人员,在执行本条例过程中滥用职权、玩忽职守、徇私舞弊的,由其所在单位或者上级主管部门给予行政处分;构成犯罪的,由司法机关依法追究刑事责任。

  第七章 附  则

  第三十五条 本条例自2007年3月1日起施行。

为了贯彻落实《国务院办公厅关于做好规章清理工作有关问题的通知》和《山西省人民政府办公厅关于政府规章和规范性文件清理工作有关问题的通知》的精神,加快建设法治政府,全面推进依法行政,市人民政府对现行有效的47件政府规章进行了清理,决定对7件政府规章予以废止,对29件政府规章予以修改。

二、决定修改的政府规章(29件)

(一)太原市人事争议仲裁办法(第18号令)

1.将第五十一条修改为:“当事人及有关人员在仲裁过程中有下列行为之一的,仲裁委员会予以批评教育、责令改正;情节严重的,由有关部门依法查处:

“(一)干扰仲裁活动,阻碍仲裁工作人员执行公务的;

“(二)拒绝提供有关文件、资料和其他证明材料的;

“(三)提供虚假情况的;

“(四)对仲裁工作人员、仲裁参加人、证人、协助执行人进行打击报复的。”

2.将第五十四条修改为:“本办法具体应用中的问题由市人力资源和社会保障局负责解释。”

(二)太原市土地储备实施办法(第19号令)

1.将第一条修改为:“为盘活存量土地资产,优化土地资源配置,合理利用土地,根据《中华人民共和国土地管理法》、《山西省实施〈中华人民共和国土地管理法〉办法》及有关法律法规的规定,结合本市实际,制定本办法。”

2.将第三条修改为:“本办法所称土地储备,是指政府依照法律、法规的规定和法定程序,对通过收回、收购、置换和征收等方式(以下简称收购)取得的国有土地进行前期整理或开发,并依据土地利用和城市总体规划配置土地资源。”

3.将第六条修改为:“集体所有土地需要储备的,必须依法办理土地征收手续。”

4.将第七条修改为:“市发展和改革、经济和信息化、商务、住房和城乡建设、规划、财政、房产、国土资源等行政主管部门应当按照各自职责,做好土地储备相关工作。”

将该规章其他条款中主管部门和相关部门的表述作相应修改。

5.将第九条(五)修改为:“政府征收的;”

6.将第十条第一款修改为:“使用权不明的土地、政府征收的土地和依法没收、收回的土地,直接由市土地储备中心进行储备。”

(三)太原市户外广告阵地有偿使用管理暂行办法(第25号令)

1.将标题修改为:“《太原市户外广告阵地有偿使用管理办法》”

2.将第一条修改为:“为加强本市户外广告设置和管理,规范户外广告阵地有偿使用活动,根据国家有关法律、法规制定本办法。”

3.将第三条修改为:“市人民政府委托市城乡规划局负责本办法的具体组织实施。市工商、市容环卫、住房和城乡建设、城管、园林、公安等部门按各自职责协助做好本办法实施工作。”

将该规章其他条款中主管部门和相关部门的表述作相应修改。

4.删除第十八条第四款。

(四)太原市城市规划管理技术规定(第27号令)

1.将第一条修改为:“为了加强和规范太原市城市规划管理,保障城市总体规划的实施,根据《中华人民共和国城乡规划法》、《山西省城乡规划条例》、《太原市城市总体规划》和国家相关技术规定、规范,结合本市实际情况,制定本规定。”

2.将第四十五条修改为:“本规定的具体应用由太原市城乡规划局负责解释。”

(五)太原市二氧化硫排污交易管理办法(第29号令)

将第五条修改为:“市环境保护行政主管部门对二氧化硫排污交易实施统一监督管理。发展和改革、经济和信息化、法制、财政、物价等部门,按照各自职责做好二氧化硫排污交易管理工作。”

(六)太原市行政机关工作人员行政过错责任追究办法(第33号令)

1.将第一条修改为:“为转变工作作风,坚持依法行政,提高行政效能,保证行政机关及其工作人员正确、及时、公正、高效实施行政管理,防止和纠正行政过错行为,根据《中华人民共和国行政监察法》、《中华人民共和国公务员法》和有关法律、法规、规章,制定本办法。”

2.将第四条第二款修改为:“人力资源和社会保障部门依照法定职责负责公务员的综合管理工作。”

将该规章其他条款中主管部门和相关部门的表述作相应修改。

(七)太原市取缔乱涂乱写和规范张贴户外小广告的管理办法(第34号令)

将第一条修改为:“为杜绝城市乱涂、乱写、乱张贴户外小广告行为,营造优美、整洁、文明、卫生的生活环境,塑造现代化城市形象,巩固我市综合整治成果,根据《中华人民共和国治安管理处罚法》和《太原市市容和环境卫生管理办法》等规定,结合我市实际,制定本办法。”

(八)太原市社会用字管理办法(第38号令)

将第四条第三款修改为:“市人民政府住房和城乡建设、规划、教育、文化广电新闻出版、工商等有关部门,在各自职责范围内,负责本系统的社会用字管理。”

(九)太原市群体性防碍公共秩序事件处置办法 (第40号令)

将第一条修改为:“为了维护省城社会稳定,保障正常的公共秩序和道路交通秩序,根据《中华人民共和国集会游行示威法》、《中华人民共和国治安管理处罚法》等法律、法规,结合我市实际,制定本办法。”

(十)汾河太原城区段风景区管理办法(第41号令)

1.将第一条修改为:“为改善生态环境,提高人居质量,加强对汾河太原城区段风景区的管理,更好地保护、利用和开发景区资源,根据国务院《风景名胜区条例》等有关法律、法规,结合本市实际,制定本办法。”

2.将第五条修改为:“市住房和城乡建设委员会是汾河景区重点保护区的行政主管部门。汾河景区管理机构受市建设行政主管部门委托,负责重点保护区的建设和日常管理工作。”

(十一)太原市城市雕塑管理办法(第42号令)

1.将第一条修改为:“为加强城市雕塑管理,提高城市文化品位,促进城市雕塑建设健康发展,使其与城市整体环境相协调,根据《中华人民共和国城乡规划法》、《山西省城乡规划条例》等有关法律、法规规定,结合本市实际,制定本办法。”

2.将第五条第三款修改为:“住房和城乡建设、房产、教育、文化广电新闻出版、市容环卫、城管、园林、公安等有关部门按照各自职责,协助做好城市雕塑管理工作。”

(十二)太原市产权交易管理办法 (第44号令)

将第一条修改为:“为规范产权交易行为,推动产权制度改革,优化资源配置,防止国有资产流失,促进太原区域经济发展,根据国家有关规定,结合本市实际,制定本办法。”

(十三)太原市燃煤污染防治规定(第45号令)

将第四条第二款修改为:“住房和城乡建设、城管、质监、工商、煤炭等行政管理部门按照各自职责,协同做好燃煤污染防治的有关工作。”

(十四)太原市城市绿线管理办法(第47号令)

将第十七条修改为:“违反本办法第十四条、第十五条第一款规定的,由市城乡管理行政执法部门按照《城市绿化条例》的有关规定予以处罚。”

(十五)太原市市容环境门前责任管理办法(第48号令)

将第四条第三款修改为:“规划、环保、公安、工商、城管、园林等有关部门按照各自职责,协同做好市容环境门前责任的监督管理工作。”

(十六)太原市国家行政机关及其工作人员行政不作为问责办法(试行)(第49号令)

将标题修改为:“《太原市国家行政机关及其工作人员行政不作为问责办法》”

(十七)太原市政府重大事项决策听证办法(试行)(第50号令)

将标题修改为:“《太原市政府重大事项决策听证办法》”

(十八)太原市行政机关及其工作人员损害政务环境行为责任追究暂行规定(第52号令)

1.将标题修改为:“《太原市行政机关及其工作人员损害政务环境行为责任追究规定》”

2.将第十条中(一)修改为:“各级行政机关设立责任追究审定组织,下设办事机构。

“责任追究审定组织由领导班子成员、监察、法制、人力资源和社会保障等部门负责人共同组成。主要职责为:决定是否进行核查、审议核查或者审理核查报告、做出处理决定;

“办理机构由监察、法制、人力资源和社会保障部门工作人员组成,主要职责为:受理投诉、检举、控告;核查损害政务环境行为;草拟核查报告、提出处理意见。”

3.将第十三条修改为:“本规定具体运用中的问题由市监察局负责解释。”

(十九)太原市设立大型商业网点听证实施办法(第53号令)

将第七条第二款修改为:“政府规划拟设立大型商业网点的,由市商务行政主管部门负责组织听证,适用《太原市政府重大事项决策听证办法》。”

(二十)太原市企业信用信息征集和发布管理办法 (第56号令)

将第七条中(一)修改为:“发展和改革、经济和信息化、住房和城乡建设主管部门提供有关企业生产、经营许可、投资行为及其他奖惩记录等信息;”

(二十一)太原市民用建筑节能管理办法(第58号令)

将第四条第三款修改为:“发展和改革、经济和信息化、财政、规划、房产等有关部门按照各自职责,协同做好建筑节能管理工作。”

(二十二)太原市城市道路井具设施监督管理办法 (第59号令)

将第四条修改为:“市城乡管理主管部门负责井具设施的监督管理。

“规划、住房和城乡建设、公安、城市管理综合执法、质量技术监督等部门应当按照各自职责,配合做好井具设施的监督管理。”

将该规章其他条款中主管部门和相关部门的表述作相应修改。

(二十三)太原市饮食娱乐服务业环境保护管理办法(第61号令)

1.将第四条的第三款修改为:“规划、住房和城乡建设、工商、城乡管理、卫生、市容环卫、商务、公安等有关部门根据各自职责,依法开展饮食娱乐服务业环境保护工作。”

2.将第十条第一款修改为:“饮食娱乐服务业应当按照法律法规的规定,向环境保护行政主管部门进行排污申报登记,领取排污许可证或者临时排污许可证;向市城乡管理主管部门进行排水许可登记,领取排水许可证,并按照许可证规定的种类、浓度和数量排放污染物。”

(二十四)太原市散状物料密闭运输管理规定 (第62号令)

将第五条修改为:“从事运输车辆密闭化改造的企业由市经济和信息化行政主管部门通过招标确定,并向社会公布。”

(二十五)太原市广播电视设施建设和管理办法(第64号令)

将第三条第三款修改为:“发展改革、财政、规划、住房和城乡建设、城管、园林、物价、公安等行政管理部门按照各自职责,协同实施本办法。”

(二十六)太原市地震安全性评价和抗震设防要求管理规定(第69号令)

将第四条第三款修改为:“发展改革、住房和城乡建设、规划、国土资源、城管等有关部门应当在各自职责范围内,做好相关工作。”

(二十七)太原市非本地户籍人口租赁房屋治安管理规定(第70号令)

将第二十五条修改为:“非本地户籍人口到住房和城乡建设、房产、民政、人力资源和社会保障、教育、计划生育、工商、卫生等政府有关部门办理相关事项时,应当主动出示居住证。”

(二十八)太原市绿色转型促进条例实施办法(第71号令)

1.将第十一条修改为:“市住房和城乡建设部门编制城市建设总体规划时,应当突出可再生能源规模化应用及主体多元化、能源多结构,鼓励采用合同能源管理模式。”

2.将第十四条修改为:“市农业、科技、经济和信息化、国有资产、住房和城乡建设、商务等部门,应当围绕构建绿色产业体系、培育绿色消费方式,制定农业、工业、建筑业、服务业以及园区和企业的绿色转型标准。”

3.将第十七条修改为:“市人力资源和社会保障、信访、住房和城乡建设、财政、卫生、旅游、文物、文化广电新闻出版等部门,应当围绕建立政府绿色管理等要求,制定绿色机关、绿色信访、绿色采购、绿色办公、绿色医院、绿色旅游、绿色文化、绿色服务等绿色转型标准。”

将该规章其他条款中主管部门和相关部门的表述作相应修改。

4.将第五十一条修改为:“市、县(市、区)人民政府有关部门及其工作人员违反本办法规定的,根据《太原市国家行政机关及其工作人员行政不作为问责办法》、《太原市行政机关工作人员行政过错责任追究办法》等有关规定追究其相关行政责任。构成犯罪的,依法追究刑事责任。”

(二十九)太原历史文化名城保护办法(第72号令)

将第六条修改为:“发展改革、住房和城乡建设、国土资源、房产、城管、财政、园林、水务、文化广电新闻出版、宗教、民政、旅游等有关部门,按照各自职责做好历史文化名城的保护工作。”

将该规章其他条款中主管部门和相关部门的表述作相应修改。

本决定自公布之日起施行。
